Please read these Terms of Use carefully before using the i-WiLL system (hereafter, “System”) provided by Overseas Courier Service Co., Ltd. (hereafter, “OCS”). By using the i-WiLL system, you agree to the following OCS Terms of Use. If you do not agree to the following Terms, OCS will not be able to make the System available to you. You assume all responsibility when accessing and using the System.
By accessing and using the System, you and/or the company that you have assigned to represent you (hereafter, collectively ,“you”) agree to these Terms.
These Terms will apply to you when using any service that is available through the System.
OCS may revise or update these Terms at any time. By continuing to use the System after such revisions and updates, you agree to those revisions and updates. OCS reserves the right to modify, add, remove, or update the System’s form and features without prior notice to you.
The System is made available by OCS. In order to use the System, you are required to have a user ID and password. You are solely responsible for the usage and management of your user ID and password. OCS requests you to not provide, transfer, lend, assign, or otherwise distribute your user ID and password to third parties for System access. System usage is limited to individuals or companies which have indicated their agreement to these Terms and have received a user ID and password in writing.
OCS makes every possible effort to ensure that your privacy is protected while using the System.
Usage of all personal information that is obtained from you is subject to protection under the OCS Privacy Policy.
Your personal information will not be disclosed or shared with any third parties without your prior consent, except when required to do so by applicable laws.
OCS assumes no responsibility or liability for the protection of any information that you have downloaded or printed from the System.
OCS reserves all intellectual property rights and licenses for the System’s software. You are prohibited from copying, reproducing, modifying, uploading, transferring, or distributing the System’s software or intellectual property rights.
OCS only grants you the right to use OCS’s services and access your data via the System. These access rights are limited to the user ID and password that is issued to you upon your agreement with these Terms. However, you are free to change the password as you wish. Unless otherwise specified by OCS, all other methods of System access and usage which are not expressly permitted by OCS are prohibited.
In addition to the restrictions described in these Terms, you also hereby agree to the following.
The shipping-related information (tracking information, pick-up location, destination, etc.) that you enter is stored by the System. The right to enter, view, and modify this information is only granted to those who use their user IDs and passwords properly.
You cannot disclose this information to any third parties or use it for purposes which are not related to OCS.
The System’s software enables you to use services that are provided by OCS.
The System is designed to operate in certain web browsers (Internet Explorer 7 or higher, Firefox 3.0 or higher, Safari 3.0 or higher, Chrome 1.0 or higher). It is not guaranteed to function in other operating environments (i.e., in other web browsers or customized systems). You are solely responsible for your use of the System. OCS assumes no responsibility or liability for any changes to your computer’s operating environment, data loss, system-related damage, or any loss or damage arising from System usage. Even if the System becomes unavailable due to reasons attributable to OCS, compensation will not be provided for any loss or damage that you experience during the time until System operations are restored.
The System may be unavailable for certain periods of time due to scheduled maintenance by OCS.
Advance notice of such maintenance periods will be provided on the OCS website.
You agree that OCS may suspend or terminate System access at OCS’s own discretion without prior notice.
In such cases, you must immediately stop using the System and securely destroy your user ID and password information. You also agree that OCS will not be responsible or liable to you even if System access is suspended or terminated.
OCS disclaims all warranties regarding the information that is available via the System.
You assume all responsibilities and risks associated with the use of the System.
The System is provided on an “as is” basis. OCS disclaims all warranties, either express or implied, including, but not limited to, warranties of merchantability, non-infringement, and fitness for a particular purpose.
OCS disclaims all warranties and makes no representations regarding the accuracy, completeness, safety, or suitability of the data, information, or services available through the System, and assumes no responsibility or liability for any loss or damage arising from their use.
To the extent permitted by applicable laws, OCS is not liable to you for any special, indirect, incidental, consequential, or punitive damages arising from the use of the System or the results of System usage, regardless of whether or not advance notice of the possibility of such loss or damage had been provided by OCS. This excludes loss or damage which OCS acknowledges as special cases and accepts responsibility for.
These limitations of liability also apply to any loss or damage that arise from the use or misuse of services, as well as the interruption, suspension, or termination of services. To the extent permitted by applicable laws, OCS assumes no responsibility even when the purposes of these limitations of liability are not satisfied.
You agree to comply with all laws and regulations which are applicable to the System and refrain from usage which is deemed by OCS to have a negative effect on OCS’s trademarks or reputation. You also agree to refrain from actions which result in OCS becoming non-compliant with laws and regulations which apply to OCS.
You cannot transfer or assign these Terms or any rights that are granted by it.
The establishment, interpretation, and implementation of these Terms, as well as your usage of the System, are governed by the laws of Japan. Any dispute arising from or in connection with these Terms or System usage is subject to the jurisdiction of the Tokyo District Court. If these Terms, including this article, are not fully recognized in a jurisdiction, users cannot use the System in said jurisdiction.
